Death Plan

I recently read a short story on death and some thoughts came to my mind. Wait wait!
This post is not about death, or the pain caused by it nor the life after death concept.

If a person dies, the family and friends will be in grief and pain. At that time, wont it be more painful to close the dead persons bank accounts, pay the pending bills and all such administrative stuff?

I think, it is better to have a document or something, which contains all the administrative details. Sure, there is something called nominee. But for paying milk bill, paper bill, cable TV amount for the month etc etc, there is no nominee. So the document should contain stuff like how much I owe others, how much others owe me. My bank details etc.

And for people like me, who are staying away from home its all the more important. Like I have paid around 40K as advance for the house to the landlord. Someone has to contact my landlord, get the money back and all if I die suddenly :-P

Last but not the least, I will make a post that ‘Prabhu is Dead’ and keep it in draft status. Give the password to another person. So on the day I am dead, the blog nominee will make that post :-D

P.S. Please read this post only from an administrative/logistics point of view than in a sentimental angle.

    Yes, makes a lot of sense. People around should know what someone owes others, what they owe him/her, otherwise it will be very difficult on a later date. After all, when one dies, everyone else isnt going to follow suit! People will live and need to know these details. This is very practical thinking.

    But keeping a draft blog ellam too much!

    Well, there’s a provision for everything legally. You can’t write in the security deposit agreement that “Incase I die XYZ should be paid”. We only need fast courts. Recently parents of a dead US soldier in IRAQ won their case to get access to their son’s Yahoo Inbox. Just to know what he was thinking during his last days.

    As grime as it may sound this is something practical to think about. And there’s something call a will. Most people don’t write one. So when they die, their loved ones are stuck trying to get money and properties changed and this takes years and a lot of hassle.

    Very sad is when wife loses husband and all accounts have been frozen that she has no money for the funeral. Coz dumbo that she was she relied 100% on husband. Sad right? Well death brings with it million and 1 problems and people complain marriages are hard! ;p

    If you have property even if its a vehicle get a will if everythings on ur name only!

    FYI
    What’s a will ?–A will is a legal declaration stating that a certain person or body will get the property you have bequeathed.

    You can will, if…You are sound, not minor, not intoxicated or suffering from an illness which renders you out of your senses.

    Who all are covered by the Indian Succession Act ?: Hindus, Buddhists, Sikhs, Jains. Muslims can will according to the Muslim Personal Law.

    Can a deity be a beneficiary ?: Yes, a minor, a lunatic, a corporation or a Hindu deity can be a beneficiary. In short, any person or body which can hold a property in its name.

    I don’t want my will to stand, what should I do ?: Just destroy the will, tear it or burn it. Or make another will. You can also lose the will. If it’s never found, it means it is revoked.

    Now, a few do’s and don’ts:

    The will should be in the person’s handwriting.

    The will should clearly indicate its purpose..

    Two witnesses, who are well and sound, should attest the will when it is signed.

    You are not supposed to make an inheritor a witness or he loses his bequest.

    The will should be simple; complications can lead to court wranglings. In any case, whenever the stakes are big, as in the case of the Birlas–it is a Rs 5,000 Cr property in question–, it is always likely to be challenged, even if it is for mere charity.

    Make sure the executor of the will is someone who is himself or herself educated, and of course, trustworthy.

    Ideally, all family members should sign a document stating that they agree to the provisions of the will.
    Otherwise, a probate may be necessary which is an expensive and tedious process.

    It’s best to name one of the largest inheritor as the executioner.

    Register the will so that it is dated.

    Don’t keep it in the bank locker.

    It’s always better to distribute family jewellery among family members beforehand in order to avoid confusion later on.

    And don’t forget to make photocopies of the will.

    You have made a very valid point. In fact I advise everybody to make a will and register it as this will make it very easy for their legal heirs to liquidate their properties, deposits, Shares, Bank accounts etc. And always buy shares, put deposits,open Bank accounts in Joint Names as it is easy deleting the name of the dead person.

    In India nomination facility is not available to all assets and there are departments where the validity of nomination is not fully accepted.
